How to Choose the Best Personal Injury Lawyer in Edmonton for You

A word about “best” and “top”

You will not find us calling ourselves the best personal injury lawyer in Edmonton, and there is a reason. The Law Society of Alberta’s Code of Conduct says lawyer marketing must be demonstrably true, accurate and verifiable, and it lists suggesting qualitative superiority to other lawyers, and raising expectations unjustifiably, as marketing that may break that rule.

Rankings and award lists are compiled in different ways. If a list of top personal injury lawyers in Edmonton influences your choice, find out how the list was made. Then judge the lawyer on the things below, which you can check for yourself.

Step one: confirm the licence

The Law Society of Alberta publishes a Lawyer Directory so the public can find and check lawyers. The Law Society says plainly that it does not recommend or endorse individual lawyers, so use the directory to confirm the person you are speaking with is a lawyer entitled to practise, not as a ranking.

Questions to ask at a free consultation

1. Who will actually handle my file, and who do I call with questions?
2. How many claims like mine have you handled, for example brain injuries, spinal injuries or disputed minor injuries?
3. Is my injury likely to be treated as a minor injury under Alberta’s cap, and why?
4. What is my limitation date, and are there shorter deadlines I have already missed or are coming up?
5. How will Section B benefits be handled while the claim proceeds?
6. Does Care-First affect my crash, and if so how?
7. What is the fee, what is the maximum, and who pays disbursements if we lose?
8. What are the weaknesses in my claim?
9. How often will you update me, and how?
10. What happens if I want to change lawyers later?

A good answer to question 8 is worth more than any advertising. A lawyer who can only tell you what is strong about your case is not giving you the full picture.

How contingency fees work in Alberta

Personal injury lawyers commonly work on contingency, meaning the fee depends on the result. Alberta’s Rules of Court set firm requirements for these agreements. A contingency fee agreement must:

• be in writing and signed by you and the lawyer;
• state how the fee is calculated and the maximum fee or rate;
• say whether you are responsible for disbursements, and no fee may be charged on disbursements recovered;
• explain how any costs award is treated;
• tell you that you may cancel within 5 days after your copy is served on you, without paying a fee, though reasonable disbursements are still owed; and
• tell you that a review officer can review the agreement and the charges at your request.

Your copy must be served on you within 10 days of signing. Read it at home before the 5 days pass.

Red flags

• A promise or “guarantee” of a result or a dollar amount
• Pressure to sign during the first meeting
• No written fee agreement, or one you are not given a copy of
• Vague answers about the percentage, the maximum fee or disbursements
• Unable to explain the minor injury cap or Section B deadlines
• You never speak to a lawyer, only intake staff

Choosing a lawyer when your claim is in Edmonton
